MLO Licensing LLC - TERMS OF USE with POLICIES AND PROCEDURES

MLO Licensing LLC (“MLO Class” or “Company”) has certain policies and procedures, as explained herein. You must acknowledge receipt and review of the terms, as well as the separate NMLS Rules of Student Conduct, to begin your course. MLO CLASS - NMLS Rules of Conduct for Students Policy

At the start of every online instructor-led and online self-study course, the student must read and acknowledge the NMLS Rules of Conduct for Students (“ROCS”), which is part of a click-through agreement incorporated into Company’s LMS. The ROCS is also included as part of the cover page or a stand-alone second page on all course materials. Company retains a log reflecting the student agreeing to the ROCS for a period of five (5) years.

REGISTRATION POLICY

MLO Class’ state of the art learning management system (“LMS”) assists students during the course registration process. The LMS is accessed through all common web browsers, including Google Chrome, Mozilla Firefox, MS Edge and Apple Safari. Access to the LMS is available 24/7 via the internet. Courses can only be taken on desktop or laptop computers, in accordance with NMLS guidelines.

Students are required to create log in credentials to create an account. The credentials consist of a username and password. An account is required to purchase NMLS approved courses marketed by the Company. The account will be used to record and preserve the start and end times of all courses. We will not sell or rent this information to anyone, in accordance with Company’s Privacy Policy.

Student information for identity verification purposes will be obtained during the registration process and will be used to confirm the student’s identity at random times throughout the course. The identity verification is done by utilizing the student’s log in credentials and answering identity verification questions.

MLO CLASS ATTENDANCE POLICY

The MLO Class Attendance policy is strictly adhered to, so please ensure that you are familiar with the policy so that you get credit for the course.

MLO Class’ LMS verifies student attendance and course integrity through in-depth verification procedures. Access to the LMS and course materials is available 24 hours a day/7 days a week via the internet, where applicable.  

To access the LMS for courses in all formats, students are required use log in credentials to access their accounts in order to start or continue the course. The log in credentials consist of a username and password created in accordance with the Company’s Registration Policy. The LMS records each login event, which formulates an attendance log. Students are completely logged out of the course after six (6) minutes of inactivity or when the student is not actively engaged in the course.

For MLO Class’ Webinar courses (classroom equivalent), validation of attendance is required to verify that the student has attended the entire course offering to receive course credit, in accordance with NMLS rules. If the course provider cannot verify full attendance, the student must re-take the entire course. 

Requirement for Student Authentication during Sign-In Process: We are required to employ a means to verify student identity by verification of Government Issued ID: Driver’s License, Passport, or equivalent.

Monitoring Attendance: We are required to verify that the student was present at the start of the course, returned from breaks, and was not tardy. Each student is required to be on camera which allows staff to verify attendance throughout the course. The course provider must monitor attendance during: 

  • Start of course 
  • Return from breaks 
  • Return from lunch

Roll Call Requirements: The course provider is required to complete roll call to verify student attendance by using the following: 

  • Use of cameras 
  • Quizzes to monitor engagement 
  • Polls to monitor engagement 
  • Instructor engagement

The LMS is also equipped with module locking to prevent a student’s rapid progression through the course, where applicable. The start and end times of all courses are recorded and preserved. All courses must be attended and completed, including any quizzes and final exams, within NMLS mandated timeframes, which are reflected in each course. Company instructors and administrators use an administrative account to access student attendance records and to verify quiz and exam completion and check scoring. The LMS administers quizzes and tests in multiple formats, including true/false, multiple choice, and/or fill-in-the-blank. Students can retake quizzes and final exams three more times. 

They can also access completed modules in order to review the content up to three times.

The instructor or course administrator tracks a student’s time using the course materials, units of instruction and assignments/activities to verify that the student’s time in the course and/or time on each topical area meets or exceeds the requirements of the SAFE Act and/or State law. A student’s progress and completion report are shown in the user dashboard as a visual progress indicator throughout the course to track student progress and activity completion. A Course Completion Certificate will be provided once course attendance and completion are confirmed and all other NMLS requirements have been met. Time logs are available in the LMS for students who completed the course at the time of annual course renewal and/or upon request.

END OF COURSE COMPLETION

MLO Class will issue a Course Completion Certificate once course attendance is confirmed through our identity verification and authentication tools and confirmation that the student completed all quizzes and passed the course final exam. Attendance logs and course time trackers are maintained by the Company.

An optional end-of-course evaluation/survey will be provided, which will request feedback to improve the course material and learning management system. 


Instructor Hiring Practices and Policy

MLO Class hires qualified instructors, who are independent contractors, possess at least ten years of experience teaching NMLS courses and meet the minimum requirements of the SAFE Act criminal background check. The Company instructors have demonstrated in-depth knowledge and skills and meet any necessary legal requirements to instruct NMLS approved courses. They are knowledgeable and subject matter experts in Federal law and regulations, the laws and regulations of at least one state and in General mortgage origination knowledge and practices.

The experience of our instructors arises from significant applicable professional experience, including in-depth work experience in the mortgage and real estate industries. They work in positions directly related to mortgage loan origination practices, including origination, underwriting, secondary marketing, operations compliance and quality control. They have mastered the course material and have experience creating lesson plans that lead students through the course topics in a timely and efficient manner. The information utilized is obtained from a diverse array of resources, including reference books, statutes and miscellaneous materials. Company instructors do not merely read from the text, materials or state/federal statutes. They are engaging and interactive and use proper industry terminology and apply it to actual situations.

Company instructors all possess the necessary organizational, interpersonal, communication and team building skills to successfully teach and foster positive relationships with our students, whether addressing an individual student or a group, and regardless of the student’s age and experience. Responses to questions are not generic; They directly respond to the specific question at issue. Our instructors are also able to work with diverse groups of individuals and are respectful of and refrain from making comments that may reveal political, cultural, or gender bias.

PRIVACY POLICY

This privacy notice discloses the privacy practices for MLO Class. This privacy notice applies solely to information collected by this website. It will notify you of the following:

  • What personally identifiable information is collected from you through the website, how it is used and with whom it may be shared
  • What choices are available to you regarding the use of your data
  • The security procedures in place to protect the misuse of your information
  • How you can correct any inaccuracies in the information

Information Collection, Use, and Sharing

We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily provide. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.

Your Access to and Control Over Information

  • Change/correct any data we have about you

Security

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Data and Document Retention Policy

MLO Class ensures the following in accordance with the NMLS data and document retention requirements of Section 3(F) of the Standards of Conduct for Approved Course Providers: 1) Data within its Learning Management System (“LMS”) is maintained and accessible; 2) Data is maintained in the event that Company transitions from one LMS to another; 3) Data and documents for all NMLS approved courses are retained for the purposes of supporting an inquiry or examination by an authorized entity.

Company’s LMS retains data and documents related to all Company NMLS approved courses for a period of at least five years. Company agrees that NMLS retains the ability to audit Course Data (as defined by NMLS Approved Course Data and Document Retention Policy) as needed, to ensure Company is properly administering courses and tracking student participation. Company will make Course Data available to the State Regulatory Registry LLC (“SRR”) within 14 calendar days of a written request from SRR. COURSE CANCELLATION AND REFUND POLICY

Online courses purchased from MLO Licensing LLC and/or MLOClass.com may be canceled within 24 hours of purchase to receive a full refund, unless you have completed the course and it has been banked with NMLS. For cancellations after the initial 24-hour period and within 30 days of purchase, 50% of the amount paid will be refunded if the course has not been used. No refunds will be granted for any online course after 30 days. Requests for cancellation and refunds must be submitted by email to info@mloclass.com.

Reactivation Fee: If the 20-hour pre-license course has not been completed or accessed within 90 days of purchase, an $80 fee must be paid to reload the course into your account. Additionally, if the 20-hour pre-license course has not been reported to NMLS within one-year of completion, the course must be taken over again to receive credit and the $80 activation fee may apply.

NOTE: If the course has not been submitted for credit to NMLS or has expired under the current calendar year, MLO Licensing LLC will not pay or reimburse you for any fines and/or fees levied by NMLS, any state agency or any other person or company. It is solely the student’s responsibility to ensure that any necessary course is timely completed and to notify MLO Licensing LLC of any completed, but uncredited, credit hours with NMLS.
